Amendments to SEB Agreement on Financial Instruments Transactions and its Part II – General Terms and Conditions
Amendments to SEB Agreement on Financial Instruments Transactions and its Part II – General Terms and Conditions – have taken effect on 20th July 2019 (for existing clients – will take effect on 2nd September 2019).
These amendments will have no significant impact on the substance of the service and the service provision procedure and are related to introduction of modern technological solutions at SEB – digital signing of documents and compliance with the requirements of the new European Union regulatory framework. Some other minor alterations have also been made, such as harmonised definitions.
As of 2018, SEB in its operations must comply with the Regulation (EU) 2016/1011 of the European Parliament and of the Council* (hereinafter referred to as the Regulation) on indices used to determine the base rate (for example, EURIBOR, EONIA, etc.). The Regulation facilitates proper functioning of the internal market while ensuring a high level of consumer and investor protection.
Under the Regulation SEB as the index user has the obligation to include in the agreement with the customer the actions it would take in the event that the index changed significantly or ceased to be provided. It is planned that in this situation the existing rate will be replaced with a new index existing in the market that meets the requirements of the Regulation.
